Alan James Ager (053565)

had breached point 18 in the Code of Conduct. It viewed the
breaches as serious matters and determined that it was appropriate
to expel Mr Ager from IOSH.
Christopher Marsh (050477)
The Disciplinary Committee upheld two allegations that Mr Marsh
had breached point 18 in the Code of Conduct. It viewed the
breaches as serious matters and determined that it was appropriate
to expel Mr Marsh from IOSH.
These were separate and unrelated cases but had some common
features. In both the two breaches of Code point 18 were being
convicted of criminal offences and failing to inform IOSH. In both
the member had made written submissions in advance and did not
appear. In both the Disciplinary Committee was satisfied it could
proceed in his absence. In both, on the documentary evidence
available, which included certification from the appropriate court,
the Disciplinary Committee was satisfied that the convictions were
‘relevant convictions’ for disciplinary proceedings. Finally, in
both, it ordered the member to contribute to IOSH’s costs in the
sum of £200.
