The HSA, is inviting comments and submissions from the
public on proposed regulations that may impact on our
sector.
Safety, Health and Welfare at Work (Reporting of Accidents,
Illnesses and Dangerous Occurrences)
Regulations
The proposal will mean that occupational illnesses which result in
more than three days absence caused by illnesses on a specified
list will be reportable to the HSA.
There are 63 illnesses on the list the majority of which cause
skin problems. Also a number of infectious diseases, such as viral
hepatitis and tuberculosis and diseases caused by certain physical
agents will be reportable.
The list of "medical conditions", are not included but are
published in a list so the list could potentially be added to
without public consultation and without the normal review process
involved when amending regulations
The rules on the reporting of accidents are also amended so
that:
· That the obligation for a member of the
family of a self-employed person who is fatally injured to report
the accident is removed and
· Where members of the public
are injured accidents are only reportable if the injured person is
taken from the site of the accident to hospital.
In relation to the reporting of dangerous occurrence there are a
number of minor amendments to the current regulations, Part X of
the General Application Regulations 1993. Part X of the 1993
Regulations will be repealed if the proposed regulations are
enacted.
